1. The Program. By enrolling in The Breakthrough Speaker Program (“the Program”), you are committing to active participation in a structured 12-month speaker development and commercialisation program delivered by The Business of Speaking (“TBOS”, “we”, “us”, “our”). This program is delivered primarily via Zoom and other platforms as nominated during the program. It is your responsibility to ensure access to a stable internet connection. TBOS will not be held responsible for your inability to access program content due to connectivity issues on your end
2. Program Commitment. The Program requires a minimum commitment of 6 months. After that initial period, your enrolment automatically continues on a month-to-month basis. You may cancel at any time after the initial 6-month period by providing written notice to TBOS no less than 30 days in advance.
3. Program Milestones & Conditional Access. The Breakthrough Speaker Program is structured around three key milestones that unlock access to certain program benefits. These milestones are:
Access to the Opportunity Board (weekly stage gigs, media, partnerships, and paid opportunities) conditional on all three milestones being completed and approved. You may complete these milestones at any time during your membership. However, the program’s stated in-market outcome is contingent on completing all three milestones. No claim may be made against TBOS for a delayed in-market outcome where milestones have not been completed. TBOS sign-off on your Signature Speech and marketing collateral is provided in good faith against program standards and is not a guarantee of market performance, speaking fees, or booking outcomes. TBOS reserves the right to withhold sign-off where, in our reasonable professional opinion, the work does not meet the standard required to represent well in the market. We will provide clear feedback and support to help you reach that standard.
4. Live Events. As part of your membership, you are entitled to attend two (2) live events per program year from the events TBOS schedules and makes available to participants in that period (“the Events”). Events are announced in advance and you select which two you wish to attend. Entry to events and in-event catering where provided are included in your membership. Travel to and from events, and accommodation, are not included and are entirely your responsibility. We strongly recommend you obtain appropriate travel insurance to cover any non-refundable costs in the event you are unable to attend. If you are unable to attend either or both of your selected events, or any events in a program year, TBOS is under no obligation to provide an alternative event, a substitute experience, a pro-rata reduction in fees, or any other form of compensation or make-good. Event entitlements do not roll over between program years. TBOS reserves the right to make reasonable changes to event dates, venues, formats, and speakers. Any such changes do not constitute grounds for withdrawal, refund, or claim.
5. The Speaker Sprint. Upon acceptance into the Program, you will receive immediate access to the Speaker Sprint - a short pre-work series designed to sharpen your core idea and introduce you to our world of story telling and speaking before your live sessions commence. The Speaker Sprint is an early access benefit included for all enrolled participants. It does not constitute a separate or standalone deliverable and does not create any additional obligation on TBOS beyond providing access to the materials. Access to the Speaker Sprint is subject to your enrolment being confirmed and your first payment having been received.
6. Intellectual Property. Throughout this program, you’ll work with powerful ideas - ours, yours, and those of your peers. Together you’ll share frameworks, stories, and materials that are the creative and commercial property of their respective owners. You have full permission to implement Breakthrough Speaker Program and The Business of Speaking content for your own use, but not to share it with or teach it to others. You agree to respect that the ideas, speeches, and materials of other participants remain theirs. Everything you create - your speech, collateral, and intellectual property - remains yours. We may, with your consent (which can be withdrawn in writing at any time), use program recordings or extracts of your work for training or promotional purposes to celebrate your success and inspire others. Any breach of this clause - including unauthorised sharing, teaching, or adaptation of materials belonging to The Business of Speaking, its representatives, or program participants - will be treated as a material breach of these Terms and may result in immediate termination of your participation without refund.
7. AI, Technology Use & Intellectual Property Protection. You acknowledge that the content, frameworks, and materials shared within this program - whether created by TBOS, its representatives, facilitators, or other participants - are confidential and protected intellectual property. You agree not to record, reproduce, screen-capture, store, distribute, upload, input, or otherwise feed any program materials, sessions, recordings, transcripts, participant content, or proprietary information - whether yours, ours, facilitators’, or other participants’ - into any system or platform without the explicit written consent of the material’s owner. This includes, but is not limited to:
TBOS uses AI-powered tools in the delivery of this program, including tools provided to you as part of your inclusions. This clause is designed to protect the intellectual property of TBOS, its facilitators, and all participants - not to restrict your use of tools provided to you by TBOS as part of the program. If you use technology or AI tools for personal note-taking or learning, you must ensure that only your own, original work is recorded, uploaded, or referenced, and that any materials containing the intellectual property of TBOS, its facilitators, or other participants are strictly excluded. Any unauthorised recording, disclosure, upload, or replication of program materials in any form or format constitutes a serious breach of confidentiality and intellectual property rights and may result in immediate removal from the program without refund, in addition to any other legal remedies available..
8. Confidentiality. Confidentiality is fundamental to this program and extends to everything shared in group settings. We respect your privacy and must ask that you respect ours and that of any fellow participants you meet or attend events with. In the course of your participation, confidential and proprietary information, plans, ideas, and trade secrets may be revealed by TBOS and other participants. You agree that you will not disclose such information to any person or entity outside of your discussions within the program, and will not use any confidential or proprietary materials acquired through the program for any purpose outside of the program, whether commercial, educational, or otherwise. By paying your enrolment you acknowledge that all confidential material and information revealed to you is the sole intellectual property of TBOS or the participant who revealed it.
9. Community Standards, Rep Tracking & Leaderboard. A central feature of this program is the community - including a rep leaderboard that tracks your progress toward 100 speaking engagements. By participating in the program, you consent to your rep count being visible to other program participants within the community platform. Revenue figures are not displayed on the leaderboard. 10. Financial Responsibility & Outcomes Disclaimer. We have made every effort to accurately represent this program and its potential. What we teach works - but like anything of value, it depends on how you show up and what you do with it. Every individual’s results will vary, and your success will depend on your background, experience, commitment, and the consistent action you take. Revenue figures, fee ranges, and target outcomes referenced in program materials - including references to ‘$5–7K per gig’, ‘$30K+ months’, ‘$100K target revenue’, or similar - are illustrative aspirational outcomes based on the experience of successful program participants. They are not promises, projections, or guarantees of what you will achieve. By enrolling, you acknowledge that TBOS cannot and does not guarantee specific financial outcomes, speaking engagements, or business results. You accept full responsibility for the decisions and actions you take in response to any advice, training, or information shared throughout the program, and for any resulting outcomes or consequences. You confirm that your investment in this program will not cause financial strain on you or your family, and that you have sought independent advice if needed. TBOS representatives - including Jacqueline Brooker - are not qualified to provide legal, tax, accounting, or financial planning advice. Any information provided is for educational purposes only. Please refer any such matters to qualified professionals. TBOS reserves the right to reassign or change your mentor or coach at any time if we believe it is in the best interests of your development or the integrity of the program.
11. Payment Terms: Breakthrough Speaker Program (Foundations). The program investment for Breakthrough Speaker Program (Foundations) is structured as follows: $2,750 Deposit on Commencement; then monthly payments of $1,980; Payment in Full for the first six months attracts a substantial discount and is $11,000 paid on enrolment.
12. Payment Terms: Breakthrough Speaker Program (Momentum). The program investment for Breakthrough Speaker Program (Momentum) is structured as follows: $3,960 Deposit on Commencement; then monthly payments of $3,960; Payment in Full for the first six months attracts a substantial discount and is $16,500 paid on enrolment.
13. Payment Administration. All amounts are in Australian dollars and are inclusive of all applicable taxes. Payments are processed on the dates agreed at enrolment. It is your responsibility to ensure your nominated payment method remains valid and funded. If a scheduled payment fails, TBOS will make reasonable attempts to contact you. Access to program resources - including the community, Opportunity Board, coaching calls, and live events - may be suspended where your account falls into arrears. Suspension of access does not constitute termination of your financial obligations under these Terms. Where a payment remains unresolved for 14 days or more, TBOS reserves the right to suspend your participation in the program. Outstanding amounts remain payable. TBOS may refer unpaid accounts to a debt recovery service and you agree to be responsible for any reasonable costs of collection. Payment by Monthly Amounts is a courtesy arrangement. They do not reduce the total amount owed.
14. Program Adjustments. TBOS reserves the right to make reasonable changes to the program that do not materially affect the core deliverables, learning outcomes, or value of your experience. This may include changes to session dates or times, delivery platforms, program structure, event venues, faculty coaches, or assigned mentors. Any adjustments will be made in good faith and with the intention of improving or maintaining the quality and effectiveness of the program. You acknowledge that such changes do not constitute grounds for withdrawal, refund, or claim.
15. Terminations & Refunds. TBOS is committed to providing every participant with a positive, productive, and professional experience. By paying your enrolment, you agree that participation in this program is a privilege, not an entitlement. TBOS reserves the right, acting reasonably and at our sole discretion, to limit, suspend, or terminate your participation - without notice or refund - if your behaviour is, in our reasonable opinion, disruptive, disrespectful, harmful, or misaligned with the values and standards of the program or The Business of Speaking brand. This includes but is not limited to behaviour that:
16. Withdrawal from Program. If on reading these Terms you would prefer not to proceed with your enrolment, you have 72 hours from the time of electronic acceptance of these Terms (verified by electronic time-stamping in our systems) to withdraw and receive a full refund. After 72 hours, it will be deemed that you are a full participant in the program and any requests for refunds received after that time will be refused, except in the circumstances expressly noted in these Terms, as required under Australian Consumer Law, or in the case of serious medical or bereavement circumstances. Medical and bereavement claims will be reviewed on a case-by-case basis with no explicit or implied obligation on TBOS to alter this position. This right operates in addition to, and does not limit, your rights under the Australian Consumer Law.
17. Dispute Resolution & Jurisdiction. TBOS is committed to maintaining open, respectful, and constructive communication. If a dispute arises out of or in connection with this Agreement or the program, both parties agree to make genuine efforts to resolve it promptly and in good faith. In the first instance, you agree to notify TBOS in writing and allow up to fourteen (14) days for informal resolution. If the matter cannot be resolved informally, both parties agree to attempt mediation in Queensland before commencing any formal proceedings. Mediation will be conducted by a mutually agreed independent mediator, and costs will be shared equally unless otherwise agreed. This Agreement is governed by the laws of Queensland, Australia. Each party submits to the non-exclusive jurisdiction of the courts of Queensland and any courts that may hear appeals from those courts.
18. Force Majeure. The Business of Speaking shall not be liable for any delay or failure to perform arising from events beyond our reasonable control, including but not limited to natural disasters, government restrictions, pandemic, or technology outages. In the event of such circumstances, TBOS will make reasonable efforts to reschedule or provide equivalent value where possible.
19. Your Rights Under Australian Consumer Law. Nothing in these Terms is intended to exclude, restrict, or modify any rights or remedies you have under the Australian Consumer Law or relevant state legislation. If any term of this agreement conflicts with the Australian Consumer Law, the Australian Consumer Law will prevail.

- Automated note-taking or cloud storage tools that collect or store program content outside approved channels.

- Engages in defamatory, unethical, or unprofessional conduct in person, online, or in public forums; or
- Breaches confidentiality, community standards, or fails to uphold the agreed program values.
